TERMS AND CONDITIONS
|

| 1) |
All payments are to
be made in advance unless agreed otherwise. Interest @ 24%
p.a. will be charged
for Credit Bills exceeding 45 days from the date of
telecast. |
| 2) |
Payment
shall be made by A/c payee cheques/Demand Drafts drawn in
favour of Ushodaya
Enterprises Limited (Television Division), payable at
Hyderabad. |
| 3) |
The
advertisement material must reach ETV (Eenadu Television, a
division of Ushodaya Enterprises Ltd.,having its Registered Office at
Hyderabad)
along with confirmed release orders at least 5 days before the intended date of telecast. |
| 4) |
The
advertisement material shall be in strict confirmity with the
"TECHNICAL GUIDELINES" prescribed by ETV. |
| 5) |
Deadline
for receiving advice regarding cancellation or postponement or
for using revised material is 5 working days prerior to the date of telecast. Only written
instructions will be entertained. |
| 6) |
If the
materials provided is to be returned to the advertiser,
intimation should be given with in 7 days from the date of telecast falling
which, the material will be destroyed and no claim will
be entertained by ETV. |
| 7) |
ETV will
issue only a certificate of telecast with basic information
like time and date of telecast. |
| 8) |
Telecast
proof copy will be maintained by ETV, for a period of 30 days
from the date of telecast, which can be witnessed at its administrative Office at Hyderabad
only. All complaints regarding non-receipt of
Bills/Telecast Certificates should reach ETV within 15 days
from the date of telecast. |
| 9) |
While due
care will be taken to telecast the advertisements as per the
instructions given in the release order, in case of any error, defect which ETV may uphold as
error or defect, liability of ETV will be
limited to re-telecast of the advertisement in due course.
Complaints in this regard should reach ETV with in 15 days from the date of telecast. |
| 10) |
ETV
reservers the right to accept/reject any advertisement or
sponsorship at its sole discretion, ETV's
decision shall be final in this regard. |
| 11) |
The tariff/terms
and conditions are subject to changes from time to time, at
the discretion of ETV. The tariff/terms and conditions
prevailing on the date of telecast shall apply. |
| 12) |
Advertisement will
be accepted for telecast subject to the Loss prevailing in
India and subject to clause 11 mentioned here in above. No
liquor/tobacco advertisements will accepted. |
| 13) |
ETV reserves the
right to telecast the advertisements in any sequence
convenient to it. If the advertisements of competetive
products are telecast in continuous sequences no claims for
waiving the advertisement charges in part or full will be
entertained. |
| 14) |
Advertisements are
accepted in good faith. In case of any legal complications
arising on account of telecasting the advertisement the
advertiser concerned shall indemnify ETV with all damage costs
and consequences thereof. |
| 15) |
ETV will not be
responsible for any disruption in telecast of the
advertisements for reasons beyond its control caused by fire,
lightning, explosion, subsidence, flood, hurricane, act of
God, civil disorder, force majeure, revolution, strikes,
lockout or trade disputes, delay in transport, communication
microwave link failures, ground segment or uplink facility or
other equipment failures, the pre-emption of transponder or
power failures, satellite or transponder failures etc. No
claims will be entertained in this regard. |
| 16) |
Any disputes or
claims arising out of these transactions are subject to the
jurisdiction of the Courts in Hyderabad only. |
| 17) |
The relase order is
accepted subject to the above terms and conditions. |
